Sometimes this strap gets bent upward and no longer provides a good contact with the tube where it goes into the transmission. Usually it is best to replace the o-ring when removing the tube. The one you are asking about has a "flange" on the upper end that seats in the bottom of the tube-hole. there is a step machined at the factory to keep the "lower" tube from going all the way into the oilpan. been there since the first small block in 1955.

You could shorten it to the point where the tube will seat- but then there's a chance the stick won't be guided down into the sump properly to give the correct oil level. I remember them being a pain because the angle is just off, and the dipstick will hit the firewall. Lifting the trans will help a bit, but you might have to tweak the tube slightly too.
